Cybersp - Term of Service

Introduction
This document sets the forth and guidelines and requirement of Acceptable User Policy (refered as AUP onwards) of Cybersp Hosting governing the use by the user (refered as customer onwards). The purpose of this AUP is to comply with the laws and to ensure the server security, availability, physical security, privacy and others that might affect Cybersp's services.
 
Domain Policy
All domains purchased through Cybersp are subject to term and condition (Uniform Domain Name Dispute Resolution Policy) that can be found here: http://www.icann.org/en/udrp/udrp.htm
 
Hosting Policy
All account will only be setup once payment had been received. Once order being placed, as long as there is no payment being made and no cancellation request being made, customer is considered owing Cybersp by that particular amount. As a proof of payment, customer will need to submit proof of payment that can be copy on bank-in slip, screen-capture of online transaction, copy of ATM deposit slip and others that is reliable. All payment is in Malaysia Ringgit.

Cybersp reserve the right to cancel its service at any time due to any circumstances. If this happened, any fees that is paid in advance (annually, bi-annual and others) will be pro-rated and the balance will be returned to customers.

Cybersp is commited in ensuring internet is the safe place to be. Inline with that, Cybersp are very strict and will not tolerate on contents and activites runs on the server that may contribute to unhealthy online environment

1. Content of hosting

Cybersp are not responsible on any hosted material on the server. Hosting any material that is promoting the violation of law and this AUP is strictly prohibited including but not limited to:

Criminal Methodology
Hosting any web contains methodoloy, steps or information that contribute to unlawful acts or violating this AUP

Scripts/Tools
Hosting scripts, tools or any resource that can be used to commit unlawful acts or violating this AUP

Phishing
Phishing is a fake web being developed with the intense to steal user's information especially login credentials.

Harvesting
Harvesting of information on the net including e-mails, phone numbers, ID number and others

Insecure script
Any script that is hosted by in users hosting space by user's responsible. If the scripts are not secure or harmful and can cause or possibly can cause damage or disruption to server, Cybersp will immediately remove the script, suspend the account or terminate the account.

Spammers' web
Hosting any web that is advertised by any spam that is send form other networks is prohibited.

Piracy
Storing any propietery item such as but not limited to this: software, application, script, crack, patch, movies, song are prohibited on Cybersp's server.

Web Proxy
Hosting a web proxy or any script that act as a proxy are not allowed.

Pornography, Child/Women Abuse
No such content that bring any means of pornography, child abuse or women abuse are allowed

2. E-mail

E-mail is used as a medium of communication. One can send message or files via e-mails. Cybersp will not tolerate on any misuse of this e-mail service as follows but not limited to:

SPAM
SPAM, Junk e-Mail and Unsolicited commercial e-mail (UCE) are defined as sending same or similar content of e-mails repeatedly send either to one or more recepients, either commercial or non-commercial. The message considered unsolicited when it's send to the group and violate its policy or send to a sender where the sender is not requested or inviteed the message. A message sent from mail server relays without the authorization of the owner, forged header or incorrect sender information wil also considered as SPAM.

Sending message contains fake instruction, fraud, scam and related from Cybersp's mailserver is prohibited. This include a message asking a receipient to browse a page which is a malicious site though the site is hosted somewhere else.

E-mail content
All contents of messages send throug Cybersp's mail server or store in Cybersp's mail server are under the responsible of the respective customer. Cybersp are not involve in contents of the message. Any message where it contents are promoting unlawful action or violation of this AUP are not allowed to be transmit or stored on Cybersp's mail server. Attachment is part of the contents.

3. Other services or application

Proxy
 With any means, no proxy server can be run on the server.

Streaming
Streaming of video or audio from the server are not allowed.

Botnet, IRC server and related
 Running botnet, IRC server or online scanner and other related stuff are prohibited.

 
Backup
Cybersp are not responsible to any losses or damage of data belong to customer store on the server regardles of why it's happened. Customer are encourage to do frequent backup on their own. Cybersp with it's own capability will do a backup of customer data with the frequent of once a week at most.
 
Suspension and Termination

For every renewal, Cybersp will send notification of payment reminder on 60, 30, 15, 5, and 1 days before the due. Any hosting account that is not being renewed by 15 days will be suspended. Any hosting account that is not renewed within 40 days will be removed. No backup will be kept.

 
Result of violation

Cybersp have the sole right to suspend or terminate service to any customer for violation of AUP without prior notice. Cybersp have the sole right to remove any malicious files or materials in any customer hosting space for violation AUP without prior notice.

Cybersp have the right to modify, add or remove any part of this AUP without prior notice to any customer. Cybersp will kept all customer informs on changes on this AUP.
